Board of Zoning Appeals
The Board of Zoning Appeals is established in accordance with Public Act 110 of 2006. The Board of Zoning Appeals is a quasi-judicial board consisting of five members. The Board is scheduled to meet on the first Wednesday of each month. However, they will not meet if there are no items of business to consider. The Mayor has historically served on the Board of Zoning Appeals and a member from the Planning Commission. The City Council appoints the members to serve three year terms, and also appoints two alternates to fill in for excused absences or conflicts of interest.
The Board of Zoning Appeals shall hear and decide appeals from and review any order, requirement, decision or determination made by the building official, any administrative official or administrative body charged with enforcement of the Farmington Zoning Ordinance where it is alleged by the appellant that there was an error or misinterpretation. The Board of Zoning Appeals mostly hears variance requests dealing with dimensional aspects of the Zoning Ordinance: set backs, building height requirements, etc. The Board of Zoning Appeals is also responsible for hearing sign and fence variance requests. Finally, while not a frequent occurrence, the Board of Zoning Appeals also hears cases dealing with interpretations of zoning map, text interpretations, and non-conforming situations.
